1. Introduction

Welcome to Battery Delivery Unit. These Terms of Service govern your use of the Battery Delivery Unit website (https://batterydeliveryunit.co.ke) and related services (collectively, the "Service") operated by Battery Delivery Unit.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

If you wish to purchase any product made available through the Service, you may be asked to supply certain information relevant to your purchase including, but not limited to, your payment details, billing address, and delivery location.

You represent and warrant that: (i) you have the legal right to use any payment method(s) in connection with any purchase; and that (ii) the information you supply to us is true, correct, and complete.

The Service may employ third-party services for the purpose of facilitating payment and the completion of purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy.

We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

3. Products

All car batteries, AGM batteries, EFB batteries, solar batteries, and other products sold through our Service are described as accurately as possible. However, we do not warrant that product descriptions or other content on the Service are accurate, complete, reliable, current, or error-free.

The images of the products on our website are for illustrative purposes only. The actual products may vary slightly from those images. We have made every effort to display products accurately but cannot guarantee that your screen's display will match the actual product.

All products are subject to availability. We reserve the right to discontinue any products at any time.

4. Pricing and Payment

All prices are in Kenyan Shillings (KES) and include applicable taxes unless otherwise stated. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice.

We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

Payment can be made via M-PESA, bank transfer, or other methods as specified on our website. We use secure payment processes to protect your information.

5. Shipping and Delivery

We deliver to locations within our service area, with fast delivery within approximately 40 minutes in Nairobi. Delivery times may vary depending on your location and the availability of products. We make every effort to deliver within the estimated timeframes; please see our Shipping Information page for details.

Delivery costs (if any) will be clearly communicated before you complete your purchase. Risk of loss and title for items purchased from our website pass to you upon delivery and installation at your location.

Professional installation is included for orders within our delivery zone where applicable.

6. Returns and Refunds

Our return and refund policy is detailed on our Return Policy page. Generally, you have 7 days from the date of delivery to return a product if it is defective, damaged, or not as described. To be eligible for a return, the item must be unused, in the same condition that you received it, and in the original packaging. Certain types of products cannot be returned, such as custom-made items or products with broken seals. Once your return is received and inspected, we will notify you of the approval or rejection of your refund.

7. Product Warranties

The warranties for our batteries vary depending on the manufacturer. We pass on all manufacturer warranties to our customers. Please contact us for specific warranty information for the products you purchase.

In addition to manufacturer warranties, we provide a guarantee that products sold through our Service will be free from defects in materials and workmanship for the period specified in the product listing or as required by law.

This warranty does not cover damage resulting from misuse, neglect, improper installation, or normal wear and tear.

8. User Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your device. You agree to accept responsibility for all activities that occur under your account or password.

To the maximum extent permitted by applicable law, in no event shall Battery Delivery Unit, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from: your access to or use of or inability to access or use the Service; any conduct or content of any third party on the Service; any content obtained from the Service; or unauthorized access, use, or alteration of your transmissions or content.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
